The Platform is owned by JACULUS TECHNOLOGIES PRIVATE LIMITED, a company incorporated under the Companies Act, 1956 with its registered office at PLOT NO.28, JAY MALHAR PARK, SAVEDI, AHMEDNAGAR, Ahilyanagar, Maharashtra, 414001 (hereinafter referred to as "Platform Owner", "we", "us", "our").

Your use of the Platform and services and tools are governed by the following terms and conditions ("Terms of Use") as applicable to the Platform including the applicable policies which are incorporated herein by way of reference. If You transact on the Platform, You shall be subject to the policies that are applicable to the Platform for such transaction. By mere use of the Platform, You shall be contracting with the Platform Owner and these terms and conditions including the policies constitute Your binding obligations, with Platform Owner. These Terms of Use relate to your use of our website, goods (as applicable) or services (as applicable) (collectively, "Services"). Any terms and conditions proposed by You which are in addition to or which conflict with these Terms of Use are expressly rejected by the Platform Owner and shall be of no force or effect. These Terms of Use can be modified at any time without assigning any reason. It is your responsibility to periodically review these Terms of Use to stay informed of updates.

For the purpose of these Terms of Use, wherever the context so requires "you", "your" or "user" shall mean any natural or legal person who has agreed to become a user/buyer on the Platform.

ACCESSING, BROWSING OR OTHERWISE USING THE PLATFORM INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS UNDER THESE TERMS OF USE, SO PLEASE READ THE TERMS OF USE CAREFULLY BEFORE PROCEEDING.

The use of Platform and/or availing of our Services is subject to the following Terms of Use:

1. Acceptance of Terms

These Terms govern your use of CapCutOff.com (the "Service"). By creating an account or using the Service you agree to be bound by these Terms. Pages such as Home, Pricing, How It Works, Contact Us, Terms of Use, and Privacy Policy are publicly accessible. The college prediction system requires mobile verification, registration, and an active paid subscription.

2. Services

CapCutOff.com is a college admission prediction platform for Maharashtra professional courses and related CAP admission rounds (including L.L.B., BBA, and B.E./B.Tech). Subscribed users receive unlimited college predictions within their active plan subscription validity based on their own score card. Available features depend on your subscription status.

To access predictions you must enter your mobile number, verify OTP, complete registration, pay for the 30-day plan, and set up your score card. Public pages may be browsed without an account.

3. Accounts & Authentication

You are responsible for keeping your account secure. Access is provided through mobile number verification (OTP). Do not share OTPs or session access with unauthorized persons. We may suspend accounts that violate these Terms.

4. Payment, Billing & Subscription

Payments are processed via PhonePe. By subscribing you authorize PhonePe and Jaculus Technologies Pvt Ltd to charge your chosen payment method for subscription fees and applicable taxes.

CapCutOff.com offers course-based 30-day plans from ₹199 to ₹499 incl. 18% GST for 30 days depending on your selected course (e.g. MBBS, BDS, B.E./B.Tech, MBA, MCA, BBA, BCA, B.Pharmacy, LLB). Each plan includes unlimited college predictions within plan subscription validity on your own score card only. Plan details are published on https://capcutoff.com/pricing.

• Minimum payment period: Minimum payment is for 30 days to activate prediction access.
• No refunds: We do not provide refunds currently. By making a payment you acknowledge and accept this no-refund policy.

5. Score Card & Merit Profile

Each subscribed account is linked to one score card. You must provide accurate name and merit score or percentile details when setting up your score card. After you save your name and merit score or percentile for the first time, those fields become locked and cannot be edited on the Platform. You may update category, reservation, domicile, and other non-locked admission details to run further predictions on the same score card while your subscription is active.

Providing false or misleading merit information may affect prediction results and may lead to account suspension. If you entered incorrect name or merit score or percentile details before saving, contact us promptly at info@jaculus.in before final submission; we generally cannot change locked fields after save.

6. Acceptable Use

You are strictly prohibited from using the Service to perform any illegal activity. We reserve the right to immediately suspend or terminate accounts used for illegal purposes without prior notice. We also reserve the right to suspend or terminate accounts that violate these Terms or applicable laws.

You must not misuse the Platform, attempt unauthorized access, scrape or redistribute cut-off or prediction data without permission, or use the Service in any way that violates intellectual property rights or the rights of others. The following activities are strictly prohibited and constitute violations of these Terms:

• Illegal Activities: Any activity that violates local, state, national, or international laws, including but not limited to fraud, money laundering, tax evasion, or any criminal activity.
• Spam and Unsolicited Communications: Sending unsolicited bulk messages, spam emails, or unwanted promotional content.
• Phishing and Identity Theft: Impersonating CapCutOff.com, other users, colleges, or authorities to steal personal information, login credentials, or financial data.
• Malware and Unauthorized Access: Introducing viruses, malicious code, or attempting to bypass Platform security controls.
• Copyright and Intellectual Property Infringement: Using the Platform to distribute copyrighted material without authorization.
• Trademark Violations: Misusing college names, logos, or branding in a way that infringes trademark rights.
• Illegal Gambling and Betting: Promoting unlicensed gambling operations, illegal betting services, or activities prohibited by law.
• Drug and Substance Abuse: Promoting illegal drugs, controlled substances, or drug paraphernalia.
• Weapons and Dangerous Goods: Selling or promoting illegal weapons, firearms, explosives, or other dangerous goods without proper authorization.
• Human Trafficking and Exploitation: Any content related to human trafficking, forced labor, or exploitation of individuals.
• Hate Speech and Discrimination: Content that promotes violence, hatred, discrimination, or harassment based on race, religion, gender, sexual orientation, nationality, or other protected characteristics.
• Child Exploitation: Any content involving minors, child exploitation, or illegal activities involving children.
• Financial Fraud: Pyramid schemes, Ponzi schemes, investment fraud, or any fraudulent financial activities.
• Privacy Violations: Collecting, storing, or sharing personal information without consent, or violating data protection laws.
• Defamation and Harassment: Content that defames, libels, or harasses individuals or organizations.
• Illegal Adult Content: Distribution of adult content that violates applicable laws, including content involving non-consenting individuals or illegal activities.

This list is not exhaustive. We reserve the right to suspend or terminate any account that we determine, in our sole discretion, violates these Terms, applicable laws, or poses a risk to users or the Service. Repeated violations may result in permanent account termination.

7. Intellectual Property

All intellectual property provided by Jaculus Technologies Pvt Ltd remains our property. You are granted a limited license to use the Service per these Terms.

8. Termination

We may suspend or terminate accounts for violations. Account closure does not entitle a refund for prepaid or consumed services.

9. Disclaimers & Limitation of Liability

The Service is provided "as is" to the maximum extent permitted by law. CapCutOff.com is an independent admission guidance platform and is not affiliated with, endorsed by, or operated by the Government of Maharashtra, the State Common Entrance Test Cell, or any other government authority. We do not provide complete historical cut-off datasets or official admission records as a standalone service. Predictions are generated using historical admission information from publicly available sources together with our own analysis and algorithms. All prediction results are estimates for informational purposes only — they do not guarantee admission, seat allotment, or CAP round outcomes. You should always rely on the official counselling process and official publications issued by the competent authority. We are not liable for indirect or consequential damages arising from use of the Service or reliance on prediction results.

In no event will the Platform Owner be liable for any indirect, consequential, incidental, special or punitive damages, including without limitation damages for loss of profits or revenues, business interruption, loss of business opportunities, loss of data or loss of other economic interests, whether in contract, negligence, tort or otherwise, arising from the use of or inability to use the Services, however caused and whether arising in contract, tort, negligence, warranty or otherwise, exceed the amount paid by You for using the Services giving rise to the cause of action or Rupees One Hundred (Rs. 100) whichever is less.

10. Governing Law

These Terms and any dispute or claim relating to it, or its enforceability, shall be governed by and construed in accordance with the laws of India.

All disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Maharashtra.

11. Changes to Terms

We may update these Terms. Material changes will be posted on https://capcutoff.com/terms with an updated effective date.

12. User Information & Account Responsibility

To access and use the Services, you agree to provide true, accurate and complete information to us during and after registration, and you shall be responsible for all acts done through the use of your registered account on the Platform.

13. Accuracy of Information

Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials offered on this website or through the Services, for any specific purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

14. Use at Your Own Risk

Your use of our Services and the Platform is solely and entirely at your own risk and discretion for which we shall not be liable to you in any manner. You are required to independently assess and ensure that the Services meet your requirements.

15. Proprietary Content

The contents of the Platform and the Services are proprietary to us and are licensed to us. You will not have any authority to claim any intellectual property rights, title, or interest in its contents. The contents includes and is not limited to the design, layout, look and graphics.

16. Unauthorized Use

You acknowledge that unauthorized use of the Platform and/or the Services may lead to action against you as per these Terms of Use and/or applicable laws.

17. Service Charges

You agree to pay us the charges associated with availing the Services.

18. Lawful Use

You agree not to use the Platform and/ or Services for any purpose that is unlawful, illegal or forbidden by these Terms, or Indian or local laws that might apply to you.

19. Third Party Links

You agree and acknowledge that website and the Services may contain links to other third party websites. On accessing these links, you will be governed by the terms of use, privacy policy and such other policies of such third party websites. These links are provided for your convenience for provide further information.

20. Binding Contract

You understand that upon initiating a transaction for availing the Services you are entering into a legally binding and enforceable contract with the Platform Owner for the Services.

21. Indemnification

You shall indemnify and hold harmless Platform Owner, its affiliates, group companies (as applicable) and their respective officers, directors, agents, and employees, from any claim or demand, or actions including reasonable attorneys' fees, made by any third party or penalty imposed due to or arising out of Your breach of this Terms of Use, privacy Policy and other Policies, or Your violation of any law, rules or regulations or the rights (including infringement of intellectual property rights) of a third party.

22. Force Majeure

Notwithstanding anything contained in these Terms of Use, the parties shall not be liable for any failure to perform an obligation under these Terms if performance is prevented or delayed by a force majeure event.
